DIVORCE IN TURKEY BASED ON GENERAL REASONS IN THE CIVIL CODE


MARITAL BREAKDOWN


According to the Turkish Civil Code, one of the spouses can file a suit for divorce if the marriage has come to a breakdown. Whether the marriage can still be protected or it has been broken down is an issue shall be decided by the judge of the Family Court.

DIVORCE BY AGREEMENT


According to the Turkish Civil Code,

spouses may be divorced by agreement. However the following requirements must be met in order for a judge of Family Court to rule for a divorce:


Ø Spouses must be married for at least a year,

Ø One party may accept the divorce suit filed against him/her,

Ø Judge must listen to the parties and be convinced that their will is hearty and real,

Ø Agreement between the parties shall include all the outcomes of the divorce regarding the property, other assets and parental right of the children. This agreement must be affirmed by the judge.

FALING TO FORM A JOINED LIFE AGAIN

According to the Turkish Civil Code, if the sposes are failed to form a joined life again in 3 years, starting from the date of rejection (final judgement) of a former divorce case between them, judge of the Family Court rules for a divorce upon the application of a spouse.


Since parties generally fail to divorce especially by agreement, when they are not represented by an attorney in the Court, it is certainly advised to work with an expert divorce lawyer - attorney in Turkey to be successfully divorced.
